StackAttack Fishing Charters Limited: Terms of Service
1. Introduction
This document ("Agreement") governs the relationship and outlines the terms and conditions ("Terms") between the charterer ("You" or "Your") and StackAttack Fishing Charters Limited, hereafter referred to as "StackAttack," "Company," "We," or "Our."
2. Formation of Contract
By submitting a deposit and being recognized as the charterer, you warrant that you have read, understood, and agreed to be bound by these Terms. The contractual relationship is solidified once the deposit payment is received by StackAttack.
3. Services

StackAttack, certified under the Maritime Operator Safety System (MOSS), provides specialized fishing charter services with custom-built vessels and professional guides.
4. Financial Terms

4.1. Pricing: All prices are denominated in New Zealand Dollars and are valid for one year from the date of reservation.

4.2. Deposit: A deposit, typically 25% of the total amount, is required to confirm your reservation.

4.3. Adjustments: StackAttack reserves the right to adjust prices to ensure business sustainability.

4.4. Refunds: Deposits are non-refundable, save for weather-related cancellations. For cancelled fully-paid trips, a refund minus the deposit can be granted.

5. Payment Methods

Payments can be made via direct credit to the provided bank details. Ensure correct references are used for timely confirmation of bookings.
6. Cancellations and Adjustments

6.1. Client Cancellation: Should you cancel within 14 days of the scheduled charter, the deposit is forfeited.

6.2. Company Cancellation: StackAttack may cancel bookings due to unforeseen circumstances, offering full refunds or rescheduling options.

6.3. Weather or Safety-Related Adjustments: In the event of early trip terminations, partial refunds proportional to the unused time may be granted.
7. Safety and Conduct

7.1. Safety Protocols: Safety instructions provided by skippers are mandatory. Non-compliance may lead to trip termination without refunds.

7.2. Health Precautions: Individuals prone to seasickness or with specific health issues should seek medical advice prior to booking.

7.3. Conduct: Excessive alcohol consumption resulting in disruptive behavior may result in early trip termination without refund.
8. Equipment & Offerings

8.1. Use of Equipment: Damage or loss of provided equipment due to negligence or misuse will result in charges.

8.2. Sustainability: StackAttack promotes eco-friendly fishing practices, and specific caps on catches apply 1 per person.
9. Data Protection and Privacy

9.1. Imagery: StackAttack reserves the right to use captured images for promotional purposes unless explicitly declined by you.

9.2. Data Confidentiality: Personal data is maintained securely and will not be shared with third parties except as necessary for service enhancement or unless mandated by law.
10. Limitation of Liability
Except where prohibited by law, StackAttack and its affiliates shall not be liable for any indirect, special, punitive, incidental, exemplary or consequential damages, or any damages whatsoever, whether or not the possibility of such damages was known.
11. Governing Law
This Agreement is governed by the laws of New Zealand. Parties agree to resolve disputes through arbitration in New Zealand.
